Warranty

Emerymark machines have a 2-year warranty on factory defects of all components and 5-year warranty on factory defects of compressor, motor, freezing cylinder, and beater. Exclusions due to negligence or failure to operate or maintain machine properly apply and are to be determined by ICES and/or Emerymark. Remote troubleshooting followed by a full evaluation and diagnosis of equipment issues or failures is to be conducted by licensed professionals approved by ICES/Emerymark and/or conducted by ICES/Emerymark prior to executing warranty terms. See detailed warranty terms. It is the customer's responsibility to ensure warranty registration is completed within 30 calendar days of delivery. Warranty on used equipment is variable and outlined in the invoice.

Payment

Payment is due in full prior to shipping or delivery of the merchandise. A 100% deposit is required to initiate the build of equipment made to order OR to send a mix test video for used equipment. Deposits are non-refundable. Once production is complete, you will be notified to pay the remaining balance on equipment. There are no returns once the machine has been shipped. Returns, before the machine has shipped, will have a 30 percent restocking fee that is mandatory.

ICES cannot hold equipment for you without payment of storage fees. Once machines are ready to ship the balance must be paid within two calendar weeks of the customer being informed the machine is ready to ship. Either the factory or the distributor is not able to hold machines without charging a rental fee of 250 dollars per month.

Machines in stock with the distributor must ship within two weeks of the final payment. Machines on deposit must be paid in full when machines are ready to ship or within six months of the initial deposit being made, whichever applies first. After that, the client will be required to pay a storage fee.

Delivery

Unless otherwise explicitly stated, shipping charges are not included in the cost of the equipment. Shipping via LTL or other carrier and/or delivery fees including insurance, liftgate, customs, tax, or other charges are detailed in this invoice, when applicable. When shipping from the FL warehouse, the customer will receive pictures of the machines loaded on the truck.

You will be provided with a tracking number for shipments. It is the customer's responsibility to document with photos and videos any damage that occurs in shipping and is noted on the BOL. Customers must be present for the delivery and inspect shipping containers for any visible damage upon arrival. Documentation such as photos or videos is required to submit an insurance claim. If there appears to be any damage, contact your ICES representative immediately, prior to accepting the shipment, for further instruction. Should damage occur during shipping, ICES will work with customers and the insurance and freight companies to receive reimbursement for damages.

Failure to mark damage on the BOL and follow the instructions can void the warranty as the insurance will not cover the damage. As long as the customer follows the directions and notes on the BOL of any damage, records with videos and photos, and has the driver call in the damage to the dispatcher the insurance will cover the damage and ICES will support the customer at each step of the insurance process. Failure to mark and or note damage puts the responsibility on the customer.

If the driver requires you to sign for the equipment before inspecting it, refuse them. Tell them no. You need to inspect it or you will mark the BOL "subject to inspection possible unseen damage driver refuses to allow inspection."
